Most would agree that the action was bold and clever. City officials say that vandalism and illegal occupation had been observed in the square in recent years. However, the situation escalated in January. New graffiti appeared, and a subculture realized that no one was cleaning it up.

What’s more, getting into the area seemed strangely easy. Groups would show up together, carrying backpacks full of spray paint. Some brought buckets of paint and rollers. The security guards on patrol were easy to evade. The names of artists and groups proliferated, and the morning sun revealed new graffiti every day.

En el mes de febrero, los líderes de la Ciudad intentaban determinar su rol en una propiedad privada que no logró tener éxito. Emitieron un ultimátum: se exigió al propietario de la plaza, Oceanwide Holdings, un grupo empresarial de Beijing, que asegurara la propiedad en cuestión de días.

In February, city leaders were trying to determine their role regarding a private property, but their efforts were unsuccessful. They issued an ultimatum: the owner of the plaza, Oceanwide Holdings, a Beijing-based business group, was required to secure the property within a matter of days.

Is graffiti protected under copyright law? This question is becoming increasingly important in today’s art world. Books, albums, T-shirts, and other products featuring graffiti images are frequently released without the consent of the original artists. A recent example is the graffiti exhibition presented at an art gallery in Buenos Aires by Peruvian artist José Carlos Martinat.

La muestra de Martinat incluía piezas de grafiti que él mismo había retirado cuidadosamente, sin autorización, de las paredes de propiedades privadas en Buenos Aires. Martinat’s exhibition included graffiti pieces that he had carefully removed—without permission—from the walls of private properties in Buenos Aires. Martinat also offered these works for sale. Local graffiti artists reacted angrily to the exhibition and collectively destroyed all of his graffiti works on site during the gallery’s opening.

Casos como este nos llevan a cuestionar si los grafiteros podrían tener alguna protección bajo la ley de derechos de autor.

Cases like this lead us to wonder whether graffiti artists might be entitled to any protection under copyright law.

Algunos grafitis pueden estar protegidos por derechos de autor, puesto que son creaciones originales realizadas en un medio físico. Pero, ¿por qué habría que resguardar expresiones que surgieron a partir de una acción ilícita pintar en propiedades que no son suyas sin autorización ? Some graffiti may be protected by copyright, since it consists of original creations made on a physical medium. But why should we protect expressions that arose from an illegal act painting on property that does not belong to the artist without permission ?

Should the law allow graffiti artists to profit from their violations? On the other hand, if the primary purpose of copyright is to encourage the creation of valuable and creative works, should we support and promote art that is illegal?
